These Terms ("Terms") govern your use of Pand Radar (the "Platform") and any content you submit — including comments, emoji reactions, and any other text, ratings, or signals (your "Contributions"). By creating an account, or by submitting a Contribution, or by checking the acceptance box, you agree to these Terms and to the Privacy Policy. If you do not agree, do not create an account or contribute.
0. Your account & acceptable use
You are responsible for your account and for keeping your credentials secure. You agree not to misuse the Platform — including by posting unlawful, infringing, defamatory, hateful, or harassing content, by attempting to de-anonymise other users, by scraping or overloading the service, or by circumventing security or rate limits. We may suspend or close accounts that breach these Terms. How we handle the limited personal data tied to your account and Contributions is described in the Privacy Policy.
1. What this Platform is (and is not)
The Platform aggregates publicly available property listings and lets people share personal, subjective opinions about them. Contributions are opinions, not statements of fact. Differing, partial, exaggerated, or plainly subjective takes are the intended purpose of the Platform, not a defect.
The operator does not verify, endorse, or adopt any Contribution, and makes no representation or warranty that any Contribution — or any listing, figure, or derived value shown — is accurate, complete, current, or fit for any purpose. Everything is provided "as is" and "as available", without warranty of any kind to the maximum extent permitted by law. Do not rely on the Platform for any decision (financial, legal, or otherwise); obtain independent professional advice.
2. Contributor licence (the rights you grant)
You retain ownership of your Contributions. To the extent your Contributions are protected by intellectual-property or database rights, you grant the operator a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable and sublicensable licence to host, store, reproduce, display, perform, publish, distribute and redistribute, translate, adapt, modify, aggregate, analyse, and create derivative works from your Contributions, in any medium and by any means now known or later developed, for any purpose connected with operating, promoting, improving, or researching the Platform (including moderation and the production of aggregated or derived data and statistics).
You waive, to the extent permitted by applicable law, any moral rights in your Contributions as against the operator and its sublicensees. This licence survives any removal of your Contribution or termination of your account, for Contributions already copied, aggregated, or redistributed.
3. Your representations
You represent and warrant that: (a) you are entitled to grant the licence in §2; (b) your Contribution is your own and does not infringe any third party's rights or any law; and (c) your Contribution contains no personal data of others, defamatory, hateful, harassing, or unlawful content.
4. Moderation, alteration, and removal
The operator may, at its sole discretion and without notice, moderate, refuse, hide, alter, replace, reorder, or remove any Contribution — in whole or in part — for any reason or none, including automated filtering of abusive or unlawful content. You acknowledge that the operator may replace the displayed text of a Contribution that its systems flag as abusive. The operator is under no obligation to display, retain, or preserve any Contribution.
5. Privacy & abuse-prevention metadata
To operate the Platform, prevent abuse, and weigh Contributions, the operator stores limited technical metadata with each Contribution — a timestamp, a coarse location (country level only, derived from network information — never a precise location), an opaque session identifier, and the originating IP address. This metadata is used for moderation, security, and analytics, is not shown publicly, and is handled in accordance with the Privacy Policy and applicable Dutch and EU data- protection law (incl. the GDPR). Your public identity is only your pseudonymous handle; your email, IP address, and coarse country are administrator-only. You may request information about, or removal of, data relating to you (see §7 and the Privacy Policy).
6. Liability
To the maximum extent permitted by Dutch law, the operator (and its officers, contributors, and suppliers) is not liable for: any Contribution or reliance on it; the accuracy, availability, or completeness of the Platform; or any indirect, incidental, consequential, or special loss. Contributions are the sole responsibility of the person who submitted them. Nothing in these Terms excludes liability that cannot be excluded under mandatory Dutch law (e.g. for intent or gross negligence).
You agree to indemnify and hold harmless the operator against claims, losses, and costs arising out of your Contributions or your breach of these Terms, to the extent permitted by law.
7. Notice, takedown & disputes (good-faith cooperation)
The operator wants to do the right thing. If you believe a Contribution or listing is unlawful, infringing, defamatory, or contains personal data that should be removed, or if you have any dispute, contact us and we will review and respond in good faith and without undue delay, and remove or correct content where a request is valid. Use the contact address shown on the Platform's About page. We aim to cooperate with reasonable, good-faith notices and lawful requests from rights-holders and authorities.
8. Governing law & jurisdiction
These Terms, and any non-contractual obligations arising out of them, are governed by the laws of the Netherlands. Disputes are subject to the exclusive jurisdiction of the competent court in the Netherlands, save where mandatory consumer-protection law grants you a different forum.
9. Changes
The operator may update these Terms; material changes bump the Version above. When the Version changes you will be asked to accept the new Terms before contributing again. Continued contribution after acceptance constitutes agreement to the then-current Terms.
If any provision is held unenforceable under Dutch law, the remainder stays in effect, and the unenforceable provision is read down to the minimum extent necessary.
