END-USER LICENSE AGREEMENT -- BLUR-TO-CLEAR

By installing or using Blur-to-Clear ("Software"), you agree to be bound by
these terms. If you do not agree, do not install or use the Software.

1. PARTIES

This Agreement is between you ("User", "you") and Brandon Heck ("Licensor",
"we", "us"), the developer and owner of Blur-to-Clear.

1. LICENSE GRANT

We grant you a limited, non-exclusive, non-transferable, revocable license
to install and use the Software on your personal devices for your own
personal, non-commercial use.

2a. Free Tier
The free tier is provided at no charge and includes all features not
designated as "Pro" within the application.

2b. Pro License
Upon purchase through Gumroad, you are granted a license to use all Pro
features. A single Pro license may be activated on multiple devices belonging
to the same individual user. Pro licenses are personal and may not be shared,
resold, or transferred.

1. RESTRICTIONS

You may NOT:

• Create a competing product. Use the Software, its source code, or any
  substantial portion thereof to build, operate, or distribute a product or
  service that competes with Blur-to-Clear, whether commercial or not.
• Sell or sublicense. Sell, sublicense, rent, lease, or otherwise transfer
  the Software or your license rights to any third party.
• Remove notices. Remove or alter any copyright, trademark, or license
  notices in the Software.
• Misuse Pro licenses. Share, sell, or distribute Pro license keys. Each
  license is for one individual user.
• Circumvent the paywall. Modify the Software to bypass, remove, or disable
  Pro feature restrictions.

These restrictions are consistent with the proprietary LICENSE under which
the Software's source code is made available.

1. THIRD-PARTY API KEYS AND SERVICES

The Software requires your own API keys from third-party AI providers
(OpenAI, Anthropic, Google, or a locally running Ollama instance). By using
these providers you agree to:

• Comply with the terms of service of each AI provider you use.
• Accept that your text is transmitted to and processed by those providers,
  subject to their own terms and privacy policies.
• Accept sole responsibility for any content you generate.

We have no control over, and accept no liability for, AI output generated by
third-party providers.

1. PAYMENTS AND REFUNDS

Pro licenses are one-time purchases through Gumroad. All payment processing
is handled by Gumroad.

Refund policy: If a Pro license does not work as described within 30 days of
purchase, contact bheckservices@gmail.com for a full refund. We reserve the
right to refuse refunds for abuse of this policy.

1. UPDATES AND CHANGES

We may release updates that add, fix, or remove features. We reserve the
right to modify free and Pro tier features at any time with reasonable notice.

1. NO WARRANTY

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR
IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS
FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE
SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED.

You are solely responsible for:
- The text you process through the Software.
- API keys you provide and any costs incurred with AI providers.
- Any actions you take based on AI-generated output. AI output may be
inaccurate or inappropriate -- always review it before use.

1. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE LICENSOR BE
LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE
DAMAGES, INCLUDING LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, ARISING
FROM: YOUR USE OF THE SOFTWARE; ANY AI-GENERATED CONTENT; COSTS WITH
THIRD-PARTY AI PROVIDERS; OR ANY SECURITY INCIDENT AFFECTING YOUR API KEYS
OR DEVICE (OUTSIDE OF OUR DIRECT NEGLIGENCE).

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR PRO
LICENSE (OR $0 FOR THE FREE TIER).

1. TERMINATION

This Agreement terminates automatically if you fail to comply with its terms.
Upon termination, cease all use and delete all copies of the Software.

1. OPEN SOURCE COMPONENTS

The webextension-polyfill library is used under the Mozilla Public License
2.0. Other dependencies are listed in package.json.

The Software's source code is available at
https://github.com/Bheck890/Blur-to-Clear under a proprietary license.
Nothing in this Agreement grants rights beyond those specified in that license.

1. GOVERNING LAW

This Agreement is governed by applicable law. Disputes shall be resolved
through good-faith negotiation first, then binding arbitration or a court of
competent jurisdiction.

1. ENTIRE AGREEMENT

This Agreement, together with the Privacy Policy at
https://bheck890.github.io/Blur-to-Clear/legal/privacy.html and the
Software's LICENSE file, constitutes the entire agreement between the parties.
